Terms of Service

These Terms of Service ("Terms") govern your use of myattending.com and joinattending.com (the "Sites"), operated by Attending Health, LLC ("Attending," "we," "us"). By using the Sites, you agree to these Terms. If you do not agree, do not use the Sites.
Medical services are separate. The Sites are marketing and informational websites. Medical care is provided exclusively by Attending Medical Group, PLLC, a Florida professional limited liability company (the "Practice"), and its licensed clinicians, through a separate secure patient platform under separate membership terms, a telehealth consent, and the Practice's Notice of Privacy Practices, each presented to you at enrollment. Attending Health, LLC is a management services organization; it does not practice medicine, and nothing on the Sites is medical advice.
1. No medical advice; no clinician–patient relationship
Content on the Sites is for general information only. It is not medical advice, is not a substitute for professional medical judgment, and does not create a clinician–patient relationship. A clinician–patient relationship is formed only after you enroll, complete intake, and are evaluated by a Practice clinician. If you are experiencing a medical emergency, call 911. Prescription medication is available only if, after evaluation, a licensed clinician determines it is appropriate for you; no medication or outcome is promised or guaranteed.
2. Eligibility
The Sites and the Practice's services are for individuals 18 years of age or older located in states where the Practice operates. The current list is at /states.
3. Acceptable use
You agree not to: use the Sites for any unlawful purpose; submit false information; attempt to gain unauthorized access to any system; scrape, harvest, or bulk-download content or data; interfere with the Sites' operation; upload malicious code; or use the Sites to develop a competing service. We may suspend or terminate access for violations.
4. Intellectual property
The Sites and their content — including the "attending:" name, wordmark, the "a:" mark, text, design, and software — are owned by Attending Health, LLC or its licensors and are protected by trademark, copyright, and other laws. We grant you a limited, revocable, non-exclusive license to access the Sites for personal, non-commercial use. No other rights are granted. Do not use our marks without written permission.
5. Third-party links and services
The Sites may link to third-party websites and services (including the patient platform, pharmacies, and manufacturer savings programs). We are not responsible for third-party content, policies, or practices; your use of them is governed by their terms.
6. Privacy
Our Privacy Policy describes how we handle information collected on the Sites. Health information you provide as a patient is governed by the Practice's Notice of Privacy Practices.
7. Disclaimers
THE SITES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. THIS SECTION DOES NOT LIMIT ANY DUTY THE PRACTICE OWES YOU AS A PATIENT UNDER APPLICABLE LAW ONCE A CLINICIAN–PATIENT RELATIONSHIP EXISTS.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ATTENDING HEALTH, LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITES, AND OUR TOTAL LIABILITY ARISING FROM OR RELATING TO THE SITES WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). THESE LIMITATIONS APPLY TO THE SITES ONLY; THEY DO NOT APPLY TO, OR LIMIT, ANY CLAIM ARISING FROM MEDICAL CARE PROVIDED BY THE PRACTICE, AND NOTHING IN THESE TERMS WAIVES RIGHTS THAT CANNOT BE WAIVED UNDER APPLICABLE LAW.
9. Indemnification
You agree to indemnify and hold harmless Attending Health, LLC from claims arising out of your violation of these Terms or misuse of the Sites.
10. Dispute resolution; arbitration; class action waiver
Please read this section carefully — it affects your rights. Any dispute arising out of or relating to the Sites or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court, and either party may seek injunctive relief for intellectual-property misuse. You and Attending each waive the right to a jury trial and to participate in a class action. The arbitration will be conducted in the county where you reside or remotely by video, and we will pay filing fees that exceed the cost of filing in small-claims court. You may opt out of this arbitration provision within 30 days of first accepting these Terms by emailing legal@myattending.com with your name and a statement that you opt out. This section applies to disputes about the Sites and these Terms. Disputes arising from medical care are governed by the membership and consent documents presented at enrollment, not by this section.
11. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles, except that the Federal Arbitration Act governs Section 10.
12. Changes
We may update these Terms by posting a revised version with a new effective date. Material changes will be flagged on the Sites. Continued use after changes take effect constitutes acceptance.
13. Miscellaneous
If any provision is found unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. These Terms, with the Privacy Policy, are the entire agreement between you and Attending Health, LLC regarding the Sites. You may not assign these Terms; we may assign them in connection with a corporate transaction.
